These Terms apply to all services operated by APEXELITECHALLENGES, including our website, mobile applications, fitness challenges, coaching services, community features, leaderboards, AI-powered tools, and related products and services, unless separate terms are expressly provided.

You must be at least 18 years old to use the Platform.

By using the Platform, you confirm that:

• You are legally capable of entering into binding agreements
• The information you provide is accurate
• You will comply with these Terms and applicable laws

The Platform provides fitness challenges, educational content, AI coaching, and general wellness information only.

We are not medical professionals, healthcare providers, or licensed dietitians.

Nothing on the Platform constitutes:

• Medical advice
• Diagnosis
• Treatment
• Professional healthcare guidance

You acknowledge that physical exercise involves inherent risks, including injury, illness, disability, or death.

You should consult a qualified healthcare professional before beginning any fitness program, exercise routine, nutrition plan, or challenge.

Participation in any activity on the Platform is entirely at your own risk.

The Platform may include AI-generated fitness or wellness recommendations.

AI-generated content may be inaccurate, incomplete, or unsuitable for your individual circumstances and should not be relied upon as professional medical or health advice.

You are solely responsible for evaluating any recommendations provided through the Platform.

Use of the Platform, including AI coaching, fitness plans, educational materials, and communications, does not create any physician-patient, therapist-client, dietitian-client, trainer-client, fiduciary, or professional advisory relationship between you and APEXELITECHALLENGES.

To access certain features, you may need to create an account.

You are responsible for:

• Maintaining account confidentiality
• Restricting access to your account
• All activity occurring under your account

You agree not to:

• Share accounts
• Impersonate others
• Use false information
• Circumvent bans or restrictions

We reserve the right to suspend or terminate accounts at our discretion.

Users may request deletion of their account at any time through available account settings or by contacting support@apexelitechallenges.com.

Certain information may be retained where required for legal compliance, fraud prevention, dispute resolution, security purposes, or the enforcement of legal rights.

The Platform may include fitness challenges, rankings, and leaderboards.

We reserve the right to:

• Review challenge submissions
• Verify uploaded videos or progress
• Remove inaccurate or fraudulent entries
• Adjust leaderboard rankings
• Disqualify participants
• Deny rewards or merchandise

Attempts to cheat, manipulate results, use misleading uploads, exploit bugs, or engage in fraudulent behavior may result in permanent account suspension.

Users may upload or post:

• Photos
• Videos
• Comments
• Messages
• Progress updates
• Community content

You retain ownership of your content.

However, by uploading content, you grant APEXELITECHALLENGES a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, moderate, and use the content for operating and promoting the Platform.

You are solely responsible for the content you upload.

You agree not to upload content that:

• Is unlawful
• Harasses or harms others
• Is sexually explicit
• Violates intellectual property rights
• Contains hate speech or threats
• Includes misleading or fraudulent challenge submissions

We reserve the right to remove content at any time without notice.

Community features such as leaderboards, comments, profiles, and social interactions may be publicly visible.

You acknowledge that information you post publicly may be viewed by other users.

Certain features, products, or services may require payment.

Payments are securely processed through Stripe. We do not store full payment card details.

We may offer:

• One-time purchases
• Merchandise
• Future subscription services

Refund requests may be reviewed on a case-by-case basis.

We reserve the right to refuse refunds where abuse, fraud, or misuse is suspected.

Certain services may be offered through recurring subscription plans.

By purchasing a subscription, you authorize recurring charges using your selected payment method until cancelled.

Subscriptions automatically renew unless cancelled before the next billing period.

Subscription pricing, billing frequency, renewal terms, and cancellation instructions will be displayed at the point of purchase.

Where subscriptions are purchased through third-party marketplaces such as the Apple App Store or Google Play Store, billing, cancellation, and refund policies may be governed by the applicable marketplace provider.

Users who successfully complete certain challenges may receive merchandise, apparel, or promotional rewards.

Reward eligibility is subject to:

• Successful verification
• Compliance with these Terms
• Availability of stock
• Accurate shipping information

We reserve the right to substitute, delay, modify, or cancel rewards at our discretion.

We do not guarantee uninterrupted or error-free access to the Platform.

Features may change, be removed, suspended, or updated at any time without notice.

We reserve the right to suspend, restrict, or permanently terminate access to the Platform without prior notice for:

• Violations of these Terms
• Fraudulent activity
• Abuse or harassment
• Harmful conduct
• Security concerns

To the fullest extent permitted by applicable law, APEXELITECHALLENGES, its directors, employees, affiliates, contractors, and partners shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to:

• Use of or inability to use the Platform
• Participation in fitness challenges
• User-generated content
• Service interruptions or technical issues
• Loss of profits, revenue, goodwill, or data
• Delays, inaccuracies, or errors in Platform content
• Reliance upon AI-generated recommendations or coaching content

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Platform shall not exceed the total amount paid by you to APEXELITECHALLENGES during the twelve (12) months preceding the event giving rise to the claim.

Your use of the Platform is entirely at your own risk.

You agree to defend, indemnify, and hold harmless APEXELITECHALLENGES from claims, liabilities, damages, losses, and expenses arising from:

• Your use of the Platform
• Your uploaded content
• Violations of these Terms
• Harm caused to other users

Your use of the Platform is also governed by our Privacy Policy.

We may update these Terms from time to time.

Updated versions will be posted with a revised "Last updated" date. Continued use of the Platform after updates constitutes acceptance of the revised Terms.

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales.

If a dispute arises, the parties agree to first attempt to resolve the matter informally by contacting support@apexelitechallenges.com.

If the dispute cannot be resolved informally, it shall be submitted to the courts of England and Wales, except where mandatory consumer protection laws grant users the right to bring proceedings in their country of residence.
